  3. Suspension of Service: We reserve the right to suspend all further pool cleaning services until all outstanding amounts, including any accrued interest and recovery costs, are paid in full.

Debt Recovery Process

John Brennan Pools is committed to fair and transparent business practices. The following outlines the steps we take when an invoice remains unpaid beyond the agreed payment terms. We believe in giving every client a fair opportunity to resolve outstanding balances before further action is taken.

Step 1 — Friendly Payment Reminder

A courtesy reminder will be sent via phone, text, or email within 48 hours of the invoice due date. We understand that payments can occasionally be overlooked, and this is simply a friendly nudge.

Step 2 — Suspension of Services

If payment has not been received before the next scheduled service visit, all ongoing pool and spa services will be suspended immediately. This includes routine maintenance, cleaning, and any outstanding warranty work. Services will not resume until the account is settled in full, including any applicable late fees. As our standard service cycle is approximately 4 weeks, clients have ample time to arrange payment before the next visit.

Step 3 — Second Notice

If payment has not been received within 7 days of the original due date, a formal second notice will be issued. This notice will restate the amount owing, the original due date, and any applicable late payment fees as outlined in our Terms & Conditions.

Step 4 — Formal Letter of Demand

If the account remains unpaid after 14 days, a formal Letter of Demand will be issued. This letter provides a final 14-day window to settle the outstanding balance in full. The Letter of Demand serves as a legal record that reasonable attempts have been made to recover the debt.

Step 5 — Referral to Debt Collection Agency

If the debt remains unresolved after the Letter of Demand period has expired, the outstanding account will be referred to a licensed debt collection agency. All costs associated with debt recovery, including agency fees and any legal costs, may be added to the outstanding balance and become payable by the debtor.

Step 6 — Credit Default Reporting

Unpaid debts may be reported to credit reporting agencies including Equifax and illion. A credit default will remain on the debtor’s credit file and may impact their ability to obtain finance, credit cards, loans, or mortgages for a period of up to five years.

Step 7 — Legal Proceedings

As a final measure, John Brennan Pools may file a claim through the NSW Local Court (Small Claims Division for debts under $20,000). If a court judgment is awarded, enforcement action may include garnishee orders on wages or bank accounts, writs for seizure and sale of property, and examination orders requiring the debtor to disclose their financial position to the court. All court filing fees and legal costs may be added to the debt.

We genuinely hope this process never needs to go beyond Step 1. If you are experiencing financial difficulty, we encourage you to contact us directly on 0491 180 575 or email john@johnbrennanpools.com.au to discuss a suitable payment arrangement. We are always willing to work with clients who communicate openly.
